3. Eligibility and Registration

You must be at least 18 years old and have the legal capacity to enter into binding contracts to use our Services. By using our Services, you represent and warrant that you meet these eligibility requirements. Certain Services may require registration or execution of separate engagement agreements.

4. Advisory Relationship and Limitations

No Guarantee of Results: While we use our specialized Technical Intake model and AI-driven processes to maximize success, we do not guarantee specific outcomes, funding approvals, or capital placement results.

8. Fees and Payment

Fees for advisory services will be outlined in separate engagement agreements. Unless otherwise specified, fees are non-refundable once services have commenced. We reserve the right to modify our fee structure with notice to clients.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PILOTHOUSE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Upon termination, your right to use our Services will immediately cease. Provisions that by their nature should survive termination shall survive, including confidentiality, intellectual property, limitation of liability, and dispute resolution provisions.

12. Dispute Resolution and Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.

Any disputes arising out of or related to these Terms or our Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in New York, NY. You waive any right to participate in class actions or class arbitrations.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of our Services after such changes constitutes acceptance of the modified Terms.
